Terms & Conditions

1. Booking & Acceptance

All quotations provided by Amethyst Audio are subject to these Terms & Conditions.

Acceptance of a quotation does not constitute a confirmed booking. A booking is only secured once the required booking fee has been received.

Amethyst Audio reserves the right to release the event date if the booking fee is not received within a reasonable timeframe.

2. Booking Fee & Payment

  • A 50% booking fee is required to secure the booking.

  • The remaining balance is due prior to or on the day of the event unless otherwise agreed.

  • No equipment or services will be delivered without the required payment being received.

3. Cancellations

  • More than 7 days prior: 100% of the booking deposit refundable

  • 7–4 days prior: 75% refundable

  • 3 days–24 hours prior: 50% refundable

  • Within 24 hours: non-refundable

Where Amethyst Audio has incurred or committed to any costs, including third-party services, equipment, or logistics, such costs may be deducted from any refundable amount or charged additionally.

4. Security Deposit

  • A refundable security deposit is required for all bookings.

  • The deposit amount will be specified in the quotation.

  • The deposit will be refunded within 7 days after the event, subject to inspection and confirmation that all equipment is returned in full and in good condition.

Amethyst Audio reserves the right to retain part or all of the deposit to cover any loss, damage, or additional costs.

Where damages exceed the deposit value, the client remains liable for full repair or replacement costs.

5. Event Services

Where Amethyst Audio provides delivery, setup, and/or operation of equipment, the company retains full control over the configuration and use of the equipment.

Clients may not operate or adjust equipment unless authorised.

6. Technical Requirements

This agreement is based on the information provided at the time of quoting.

The client is responsible for providing all relevant technical information, including:

  • Power requirements

  • Event layout

  • Performer technical riders

Changes to event requirements may result in revised costs or system adjustments.

7. Power Supply

The client must provide a stable and adequate power supply unless otherwise agreed.

Amethyst Audio is not responsible for issues arising from:

  • Insufficient power

  • Unstable electrical supply

Additional power solutions (e.g. generators) may be quoted separately.

8. Safe Working Environment

The client must provide a safe and suitable working environment for personnel and equipment.

This includes:

  • Stable setup surfaces

  • Weather protection where required

  • Safe access to all working areas

  • Reliable power sources

  • Compliance with safety regulations

Amethyst Audio reserves the right to delay, modify, or suspend services where conditions are deemed unsafe.

In such cases, Amethyst Audio is not liable for any resulting disruption and fees paid may be non-refundable.

9. Environmental Conditions

The client is responsible for ensuring suitable environmental conditions, including protection from:

  • Rain and moisture

  • Dust

  • Excessive heat

Damage caused by unsuitable conditions may be charged.

10. Equipment Responsibility

All equipment remains the property of Amethyst Audio.

The client is responsible for equipment from delivery until collection and will be liable for:

  • Loss

  • Theft

  • Damage

Equipment must be used only for its intended purpose and in a safe manner.

11. Setup, Access & Collection

The client must ensure:

  • Timely access to the venue

  • Suitable setup conditions

  • Safe collection of equipment after the event

Delays or restrictions may result in:

  • Additional charges

  • Extended hire fees

12. Delays, Overtime & Event Overrun

Delays caused by the client or third parties may result in additional charges.

Use of equipment beyond agreed event times without prior approval may result in overtime charges.

13. Service Limitations

Amethyst Audio is not responsible for:

  • Reduced performance caused by delays or incomplete setup

  • Limitations imposed by venues or authorities (including sound restrictions)

14. Third-Party Services

Amethyst Audio may use third-party suppliers or equipment where necessary to fulfil booking requirements.

The company is not responsible for third-party equipment or personnel not supplied directly.

15. Right to Refuse or Withdraw Services

Amethyst Audio reserves the right to refuse or withdraw services where:

  • Terms and conditions are not met

  • Conditions prevent safe or proper operation

This does not constitute a breach of contract.

16. Indemnity

The client agrees to indemnify and hold Amethyst Audio harmless from any claims, damages, or liabilities arising from:

  • The event

  • Use of equipment

Except where caused by proven negligence by Amethyst Audio.

17. Limitation of Liability

Amethyst Audio’s total liability is limited to the total amount paid for the services.

The company is not liable for indirect or consequential losses, including:

  • Loss of income

  • Event disruption

18. Insurance

The client is responsible for ensuring appropriate public liability insurance where required.

Amethyst Audio reserves the right to request proof of such insurance based on event risk.

19. Force Majeure

Amethyst Audio is not liable for failure or delays caused by events beyond its control, including:

  • Weather conditions

  • Power failures

  • Government restrictions

  • Emergencies

20. Media & Promotion

Amethyst Audio reserves the right to capture and use content from events for marketing purposes unless otherwise agreed.

21. Sponsorship Arrangements

Where services are provided as part of a sponsorship, the rental value remains applicable but may be waived at Amethyst Audio’s discretion.

Equipment care and liability responsibilities remain unchanged.

22. Entire Agreement

These Terms & Conditions constitute the entire agreement between the parties and supersede any prior discussions or agreements unless confirmed in writing.

23. Governing Law

This agreement is governed by the laws of South Africa
